1. Acceptance of Terms
These Terms & Conditions govern the boat rental agreement between the client (hereafter referred to as “the Client”) and Fazana Tours (“we”, “us”, or “the Charter Company”). By confirming a booking and/or making any payment (partial or full), the Client confirms acceptance of these Terms on behalf of themselves and any passengers included in the booking. This acceptance holds the same legal weight as a signed agreement.
2. Charter Company Obligations
We commit to providing a vessel that is:
- In full working condition
- Equipped as described in the listing
- Delivered with full fuel and water tanks
- Accompanied by valid documentation and permits
Should we be unable to provide the agreed vessel due to unforeseen circumstances (e.g., breakdown), we reserve the right to offer a replacement of equal or higher quality. If no substitute is available, the Client is entitled to a refund for the days when the boat was not usable. This refund is limited strictly to the paid rental amount.
Damages due to natural causes will be repaired within 24 hours of notification. No refund is issued in such cases.
3. Client Responsibilities
The Client agrees to:
- Operate the boat safely and responsibly
- Comply with all maritime laws and local regulations
- Notify us immediately in the case of damage, accident, loss, or theft
- Provide accurate information regarding crew and passengers
- Return the vessel in the same condition as received (clean, undamaged, full fuel tank)
In case of gross negligence (e.g. operating the boat under the influence, reckless behavior, or unauthorized sailing routes), the Client is liable for full financial and legal consequences, including damages not covered by insurance.
If the vessel is lost, seized, or prohibited from sailing due to the Client’s actions, the Client must immediately inform Fazana Tours and the relevant authorities.
4. Boat Check-out & Return
The Client must return the boat:
- On the agreed date and time
- At the agreed location
- With a full fuel tank
- In clean and undamaged condition
Late returns will be charged at 300% of the daily rate, calculated per hour. Exceptions may be made in verified cases of force majeure, but only if the Client informs Fazana Tours promptly.
5. Skippered Charters & Crew Conduct
If a skipper or crew member is provided by Fazana Tours, the Client agrees to:
- Treat all staff with respect
- Follow the skipper’s instructions related to safety and navigation
- Not interfere with the skipper’s operational decisions
The skipper retains the right to terminate the charter in case of unsafe, illegal, or abusive behavior by any passenger.
6. Security Deposit & Insurance
A security deposit may be required prior to departure, either in cash or pre-authorized on a card. The deposit will be refunded after inspection, provided no damage or contract breach has occurred.
Our vessels are fully insured, but the Client remains liable for:
- Damage caused by negligence or intoxication
- Lost or stolen equipment
- Fines or penalties resulting from illegal behavior
7. Cancellations & Refund Policy
Cancellations by the Client:
- More than 30 days before charter: full refund
- 15–30 days before charter: 50% refund
- Less than 15 days before charter: no refund
Cancellations by Fazana Tours:
In case of technical issues, bad weather, or other force majeure events, Fazana Tours may cancel the charter and offer either:
- A full refund, or
- A rescheduled charter (subject to availability)
8. Complaints
Any issues must be reported immediately during the charter. Only complaints submitted in writing during check-out will be considered valid.
9. Jurisdiction
All disputes arising from this agreement shall fall under the jurisdiction of the courts of the Republic of Croatia.
